Cancellation policy
General Rental and Cancellation Terms
1. Reservation and Rental Agreement
A reservation becomes binding once the tenant has completed and submitted the booking form and the landlord has confirmed the reservation in writing.
After submitting the booking form, the tenant has 7 days in which to cancel the reservation free of charge. The cancellation must be received by the landlord in writing, preferably by email, within this period.
After this 7-day period has expired, the reservation becomes final and the cancellation terms set out below will apply.
The tenant is responsible for providing accurate and complete information when making the reservation.
2. Payment
The agreed rental price and payment schedule will be stated in the booking confirmation or rental agreement.
All payments must be made within the payment deadlines specified by the landlord.
If a payment is not received on time, the landlord may notify the tenant in writing and provide a reasonable period in which to make the outstanding payment.
If payment remains outstanding after this period, the landlord reserves the right to cancel the reservation and, where legally permitted, recover any resulting costs from the tenant.
3. Cancellation by the Tenant
Any cancellation must be made in writing, preferably by email.
The date on which the written cancellation is received by the landlord will be considered the official cancellation date.
If the tenant cancels within 7 days of submitting the booking form, no cancellation fee will be charged.
After the 7-day cancellation period, the following cancellation fees apply:
More than 4 weeks before the start of the rental period: 35% of the total rental amount is due.
4 weeks or less before the start of the rental period: 100% of the total rental amount is due.
Cancellation fees are calculated on the full agreed rental amount, regardless of whether the amount has already been paid in full or in part at the time of cancellation.
4. Replacement Tenant
If the tenant is forced to cancel after the 7-day cancellation period, the tenant may propose a replacement tenant.
A replacement tenant will only be accepted with the prior written approval of the landlord.
The landlord reserves the right to refuse a proposed replacement tenant.
If the replacement tenant is approved, a new rental agreement will be drawn up between the landlord and the replacement tenant.
An administration fee of €50 will be charged for preparing and processing the new rental agreement.
The original tenant remains responsible for the reservation and all associated payment obligations until the new rental agreement has been signed by all relevant parties and any applicable payments have been received.
5. Changes to a Reservation
Changes to an existing reservation are only possible with the prior approval of the landlord.
Changes to the rental period, number of guests or other essential details of the reservation may result in a change to the rental price.
The landlord is not obliged to accept a requested change if the change is not possible due to availability or other circumstances.
6. Early Departure
If the tenant decides to leave the property before the agreed end of the rental period, the full agreed rental amount remains payable.
No refund will be given for unused days or for any other unused portion of the rental period.
7. Number of Guests and Use of the Property
The property may only be occupied by the number of guests specified in the booking and rental agreement.
Additional guests may not stay at the property without the prior written approval of the landlord.
The property may not be sublet or transferred to another person without the prior written consent of the landlord.
The tenant must use the property, furniture, equipment and facilities with due care and treat the property as a responsible tenant would.
8. Damage and Security Deposit
The tenant is responsible for any damage caused during the rental period to the property, its contents or other belongings of the landlord, insofar as such damage can reasonably be attributed to the tenant or to persons for whom the tenant is responsible.
Any damage must be reported to the landlord as soon as reasonably possible.
If a security deposit applies, it must be paid in accordance with the terms stated in the rental agreement.
Provided there is no damage or other outstanding obligation, the security deposit will be refunded within the period specified in the rental agreement.
The landlord may deduct the cost of damage or other outstanding amounts for which the tenant is responsible from the security deposit.
9. Force Majeure
If circumstances beyond the landlord's reasonable control prevent the property from being made available, the landlord will inform the tenant as soon as reasonably possible.
Force majeure may include, but is not limited to, natural disasters, fire, serious damage to the property, government measures, war, serious emergencies and other circumstances that make the rental period reasonably impossible.
If the stay cannot take place due to force majeure, the landlord and tenant will consult with each other to find an appropriate solution, such as rescheduling the reservation.
The rights and obligations of both parties in the event of force majeure are also subject to applicable law and any mandatory statutory provisions.
10. Liability
The landlord is not liable for loss, theft or damage to the personal belongings of the tenant or the tenant's guests, except where the landlord is liable under mandatory applicable law.
The tenant is responsible for arranging adequate travel and cancellation insurance.
The tenant must comply with all applicable safety regulations and house rules during the stay.
11. Travel and Cancellation Insurance
The landlord strongly recommends that every tenant take out adequate travel insurance and cancellation insurance when booking the property.
Such insurance may provide cover if the tenant is unable to travel or is required to terminate the stay early due to unforeseen circumstances.
If the tenant chooses not to take out such insurance, any resulting financial consequences remain the responsibility of the tenant.
12. Written Communication
All cancellations, amendments and other important communications relating to the reservation must be made in writing. Email shall be considered an acceptable form of written communication.
13. Applicable Law
The rental agreement and these terms and conditions shall be governed by the law specified in the rental agreement.
If any provision of these terms and conditions conflicts with mandatory applicable law, the mandatory legal provisions shall prevail.
